Rule 4
“Make the enemy live up to its own book of rules.”
The whole dispute is a book-of-rules fight, and both sides are playing it. Averkiev got a teacher's spoken agreement in September 2025 to advance notice and an opt-out, and the district later honored only the exemptions state law already compels — sex-education and health surveys — while denying the rest; ADF's suit exists to hold the district to its own promise and to the federal rule announced in Mahmoud v. Taylor. The gap between 'partnership with families' language and what was actually granted is the leverage.
Counter-Rule 4 · Radical Integrity
Close the gap between stated values and actual practice before anyone else finds it. This tactic only works where the gap is real.
Close your own gap first: never rely on a verbal yes. Put every opt-out request in writing this month, keep the reply, and follow the district's stated procedure exactly — the policy number, the named designee, the form. If you later have to say the district did not follow its own rules, your file must show you followed them to the letter.
Rule 3
“Whenever possible, go outside the expertise of the enemy.”
The argument was moved onto ground parents rarely know. The district's answer was procedural — exemptions granted only where a statute mandates them, refused for counseling sessions and pronoun practice, where no statute is as explicit — so a father with a religious objection ends up litigating notice requirements and curriculum categories rather than beliefs. Averkiev needed a national legal team to contest a fifth-grade lesson plan.
Counter-Rule 3 · Preparation and Width
Prepare the unfamiliar ground before you are dragged onto it. "I don't know, I'll find out and come back" beats an improvised answer.
Read the two Washington statutes before you speak: RCW 28A.300.475(7), which says a written excusal request from comprehensive sexual health education must be granted and requires schools to provide course materials by grade, and RCW 28A.605.005, the 2024 Parents' Bill of Rights, which lists the right to examine curriculum and supplemental materials. Read the Mahmoud syllabus. At the meeting, if you are handed a term you don't know, say you'll find out and come back.
Rule 8
“Keep the pressure on, with different tactics and actions.”
Notice the rhythm: a request in September 2025, an agreement, a June Pride Month lesson the boy sat through anyway, then renewed requests at fifth grade rejected 'nearly all.' Each year the parent must start over, and each year the denial is partial, so there is always something left to appeal. Attrition, not a single refusal, is what wore the accommodation away.
Counter-Rule 8 · Institutional Resilience
Decide in advance, in writing, what the institution will and will not concede — so exhaustion cannot make the decision for it.
Decide in writing, before the next request cycle, what your household will and will not accept — which lessons you will withdraw from, what notice you need, at what point you escalate to the board — and give a copy to two other families or your pastor. Calendar the request for the first week of the school year rather than waiting for a lesson to surprise you.
