Trump Admin Forces Topeka Schools to End Secret Gender Plans

Rule 4
“Make the enemy live up to its own book of rules.”
The whole enforcement action runs on holding districts to a rulebook they already accepted: FERPA, the condition attached to the federal money they take. The Education Department did not argue about gender ideology in the abstract — it found that Topeka, Olathe and Shawnee Mission maintained policies instructing staff to withhold gender-identity information from parents, which collides with the parental access rights FERPA guarantees, and Topeka signed a resolution agreement rather than defend the gap. Topeka's own public statement that it is committed to "partnering with parents" is exactly the stated value the finding measured its policy against.
Counter-Rule 4 · Radical Integrity
Close the gap between stated values and actual practice before anyone else finds it. This tactic only works where the gap is real.
Apply it to yourself first. Read your own district's records policy and your church school's or homeschool co-op's records practice this month and fix any place where your side keeps a file a parent has not seen. Then, when you request records, follow the district's stated procedure to the letter — written request, correct office, keep a dated copy — so no one can answer your substance with your paperwork.
Rule 3
“Whenever possible, go outside the expertise of the enemy.”
The fight has been moved onto ground where ordinary parents are out of their depth: what counts as an "education record," whether a plan kept in a counselor's file is one, whether the label "gender support plan" is even used. Shawnee Mission's refusal letter turns on the claim that it does not create or maintain "gender support plans," and Washington's OSPI has argued that what a staff member knows personally never becomes a record at all. A parent who shows up with conviction and no vocabulary loses that exchange.
Counter-Rule 3 · Preparation and Width
Prepare the unfamiliar ground before you are dragged onto it. "I don't know, I'll find out and come back" beats an improvised answer.
Get competent on the narrow ground before you stand on it. Read the Department's plain-language FERPA page — parents must be allowed to inspect and review records within 45 days of a request, and complaints to the Student Privacy Policy Office must be filed within 180 days. Ask for documents by description (any plan, form, or note about names, pronouns or gender identity, wherever kept), never by the district's label, and if you are asked something you don't know, say you will find out and come back.
Rule 11
“If you push a negative hard and deep enough, it will break through into its counterside.”
The negative is being pushed hard enough to overshoot the record. This alert calls Mirabelli v. Bonta a Supreme Court ruling "affirming parental authority" when the Court's March 2026 action came on its emergency docket over a stay of a district judge's injunction, counts four Kansas districts where the Department's release names three, and says Topeka was forced to end plans that Topeka publicly says it never had.
Counter-Rule 11 · Proportional Truth
Refuse to overclaim, even where it would help. One exaggeration hands the other side the only weapon that works permanently.
Refuse the extra inch even where it helps. Before you speak at a board meeting, write down only what you have read on ed.gov or in a court docket, with the date, and let the rest go. Say "a federal finding in April 2026 against three Kansas districts" instead of "nationwide secret transition programs" — the narrower claim is the one nobody can knock down, and one correction in public costs you every other item on your list.
