Rule 4

“Make the enemy live up to its own book of rules.”

The district's own paperwork is the hinge of this story: Becket's account says Sunnyvale first worked with the family and sent them an opt-out form that listed religious objection as a ground, then reversed and declared the curriculum not subject to parent opt-out. The parents are now holding the district to two of its own books of rules at once — the form it issued, and the Supreme Court's June 27, 2025 ruling in Mahmoud v. Taylor, which the district reportedly waved off as applying to another state. The tactic works here only because the gap between what the district published and what it practiced is real and documented.

Counter-Rule 4 · Radical Integrity

Close the gap between stated values and actual practice before anyone else finds it. This tactic only works where the gap is real.

Close that gap in your own file before you speak. Put your opt-out request in writing under Education Code 51240, keep the district's reply, keep the dated form or handbook page you relied on, and read the Mahmoud syllabus yourself rather than quoting a summary. At the board meeting, quote the district's own document back and ask for the policy number — not for a change of heart.

Rule 3

“Whenever possible, go outside the expertise of the enemy.”

A request that began as a one-page form has been moved onto ground almost no parent can stand on unaided: federal litigation, with Becket and a law-school clinic on one side and district counsel on the other. Telling teachers to resist parental pressure and treating a Supreme Court decision as an out-of-state matter are legal-sounding claims an ordinary parent cannot evaluate at a three-minute microphone. The venue shift is itself the tactic.

Counter-Rule 3 · Preparation and Width

Prepare the unfamiliar ground before you are dragged onto it. "I don't know, I'll find out and come back" beats an improvised answer.

Prepare the narrow ground before you are pulled onto the wide one. Read the two short things that actually govern your request — Education Code 51240 and the Mahmoud holding — and learn your district's public-comment and records-request procedure. When an administrator cites a statute you have not read, write the number down and say you will look it up and come back; never improvise a legal answer at the microphone.

Rule 7

“A tactic that drags on too long becomes a drag.”

The concession is explicitly temporary — the district agreed to excuse the four plaintiff children while the case is pending, which is why the headline says "for now." That is a bet that parental attention is a burst and litigation is a marathon: the agreement covers named plaintiffs, not the district generally, and can lapse when the case resolves. Nothing in the reporting shows a board vote changing any policy.

Counter-Rule 7 · Strategic Steadfastness

Outlast it. Novelty is the attacker's fuel and it runs out faster than patience does.

Outlast it by putting the calendar to work. Diary the next three board meetings now, ask each month for the current status and the policy number in writing, and file your own opt-out request rather than assuming someone else's court case covers your child. Refuse to treat the September news as a settled win, and refuse to let the file go quiet when the news cycle does.
