The actual legal picture is genuinely technical: Alamo Plaza is city-owned but leased to the General Land Office under a 100-year lease executed in October 2018 and amended in May 2024, and the site's own rules label most of the complex a 'nonpublic forum' while confining advocacy to a marked circle. A five-minute ultimatum on that kind of ground is a decision made where the demonstrators had the least expertise and the officer the most.

Prepare the unfamiliar ground before you are dragged onto it. "I don't know, I'll find out and come back" beats an improvised answer.

Before the next outreach, read the Alamo's published site rules and the Dallas Express reporting on where the zone sits, print them, and carry them. Learn the one distinction that matters on scene: a city ordinance and a landowner's house rule are not the same thing, and criminal trespass under Penal Code 30.05 turns on notice to depart. If an officer cites nothing, say plainly 'I don't know what rule that is — I'll find out and come back,' comply, and file a Chapter 552 records request that afternoon rather than litigating on the sidewalk.

The lever in this story is not the arrest, it is the countdown: five minutes to comply 'or face arrest.' The threat did the work of clearing the sidewalk long before any charge was filed. What the threat actually resolved to, per the booking records reviewed by the Dallas Express, was a criminal trespass charge — generally a Class B misdemeanor in Texas — with both named men out on bond the next day.

Name the worst case out loud and cost it honestly. Fear of the unnamed is doing most of the work.

Cost the worst case out loud in advance, in writing, with your group: booking, a night in Bexar County, bond, court dates, an attorney's fee, and what a Class B misdemeanor conviction would and would not do to your job and your record. Decide beforehand who stays, who films, who calls the lawyer, and who does not get arrested because they have children at home. A group that has priced arrest is not moved by a five-minute clock; a group that has not is moved by nothing else.

“Make the enemy live up to its own book of rules.”

The Alamo's own book of rules is the ground the activists chose to stand on, and the story names the exact sentence: a plaque in the pavement quoting Franklin that there is no public liberty without freedom of speech, and site rules that say the Alamo respects First Amendment rights while directing advocacy to one small circle. The gap between the engraved claim and the enforcement of an uncited internal rule is the entire case Grisham says he will take to court.

Close the gap between stated values and actual practice before anyone else finds it. This tactic only works where the gap is real.

That tactic only works where the gap is real, so close your own first: if your group's stated commitment is to peaceable, lawful witness, then no blocked pathways, no amplification where the published rules forbid it, no obscuring the graphic-image question. Write down your own standard of conduct before the next event and hold to it, so that when you point at the Franklin plaque nobody can point back. Get the written policy through a records request and quote it accurately rather than characterizing it.
