“If you push a negative hard and deep enough, it will break through into its counterside.”

The alert's own two sentences do not match: the headline says New York City is "Defying Federal Ban," while the body says only that the contracts run counter to "a federal Department of Justice position" and that hospitals have faced funding threats. A position and a subpoena campaign are not a statute; pushing the word "ban" that hard is the negative driven past what the facts carry, and it is exactly the kind of overstatement that converts into the other side's best evidence when a reader repeats it in public.

Counter-Rule 11 · Proportional Truth

Refuse to overclaim, even where it would help. One exaggeration hands the other side the only weapon that works permanently.

Before you quote this alert, write down the two claims separately: twenty-seven states have acted (state law) and DOJ has taken an enforcement posture (federal). Say "there is no federal statute banning this; there are state bans and a federal enforcement campaign" — that sentence costs you nothing and cannot be refuted at a council meeting. Refuse to use the word "illegal" about the contracts unless someone can hand you the statute number.

“The threat is usually more terrifying than the thing itself.”

The pressure described here is largely threatened rather than executed: hospitals "have faced threats" of losing research grants and Medicaid/Medicare funding, and DOJ announced in June 2025 that it had served more than twenty subpoenas on clinicians. What actually happened in court is less dramatic — district courts in Boston, Philadelphia and Seattle quashed or narrowed those subpoenas in 2025, and a Colorado court did the same on January 5, 2026, finding no articulated law-enforcement purpose.

Name the worst case out loud and cost it honestly. Fear of the unnamed is doing most of the work.

Name the worst case out loud and price it: read the published summaries of the quashed-subpoena rulings before telling anyone that providers are about to be prosecuted or defunded. Keep a one-page file with the date and court of each ruling, and when someone says "the feds will shut this down," answer with what the docket actually shows. Fear that is costed stops being usable by either side.

“Make the enemy live up to its own book of rules.”

Gerard Kassar's criticism is a textbook use of this rule: he does not argue the medicine, he holds the city to a consent standard it already applies elsewhere, asking why these contracts carry no parental-consent safeguards "comparable to those required for abortion." The tactic works only if that gap is real and documented in the city's own rules — which is precisely what the alert does not show.

Counter-Rule 4 · Radical Integrity

Close the gap between stated values and actual practice before anyone else finds it. This tactic only works where the gap is real.

Do the homework before you repeat the comparison: ask the Health Department in writing for the actual consent policy and its policy number, and ask the Council for the contract language on parental notification. Then close the same gap at home — ask your church or school for its own written parental-consent and medical-referral practice for youth programs, with the date it was adopted, so the question you are asking of the city is one you can answer about yourself.
