Massachusetts Expands Legal Abortion Later in Pregnancy

Rule 3
“Whenever possible, go outside the expertise of the enemy.”
The old statute gave laypeople something they could read: four written conditions in M.G.L. c.112 §12N (life, physical or mental health, lethal fetal anomaly, grave diagnosis incompatible with sustained life). Chapter 188 replaces all of it with 'an abortion may be performed by a physician based upon the professional judgment of the physician,' and the rewritten §12N½ says no medical review process may override that judgment. The contested ground moves from statutory text, which a citizen can quote, to clinical discretion, where any objection can be dismissed as unqualified.
Counter-Rule 3 · Preparation and Width
Prepare the unfamiliar ground before you are dragged onto it. "I don't know, I'll find out and come back" beats an improvised answer.
Spend an hour this month reading the actual words rather than the headlines: Chapter 188 of the Acts of 2026 is three short sections on the Legislature's own site, and §12N, §12N½, §12O and §12P of Chapter 112 are a page each. Write down exactly which words were struck and which survive, so that in conversation you are quoting the statute, not your impression of it. When asked a medical question you cannot answer, say you will find out and come back rather than improvising.

“If you push a negative hard and deep enough, it will break through into its counterside.”
The case made for the bill was pressed at its most sympathetic extreme — a late lethal fetal diagnosis, a family forced to travel out of state — and pushed hard enough that it carried a general repeal of all four statutory conditions and of the requirement that post-24-week abortions occur in a hospital with obstetrical services. The press release names the hard case; the enacted text contains no such limit. The same dynamic runs the other way in commentary that describes the law simply as 'abortion up to birth' without noting that physician-only performance and the §12O duty toward a live birth survive untouched.

Refuse to overclaim, even where it would help. One exaggeration hands the other side the only weapon that works permanently.

In any letter, meeting comment or Sunday-school handout, say precisely this: Chapter 188 struck the four listed conditions and the hospital-only requirement, and barred medical review from overriding the treating physician — and note that §12O and the physician-only rule remain. One exaggeration that gets corrected in public costs you every accurate thing you said alongside it.
Rule 12
“The price of a successful attack is a constructive alternative.”
The entire public argument for the bill was that women receiving a devastating diagnosis at 30 weeks had nowhere in Massachusetts to go and had to leave the state. That is an attack whose force comes from an absence — and it is answered not by a better slogan but by the thing that fills the absence. Action item 2 on this alert points at exactly that: the local centers that would have to be the alternative.
Counter-Rule 12 · Universal Construction
The book agrees with this one rather than inverting it: if you would tear something down, you are obliged to build the thing that replaces it.
Find out this month what actually exists within driving distance for a family given a lethal fetal diagnosis at 28 weeks — perinatal hospice, a hospital palliative-care team, bereavement doulas, a pregnancy center with a medical director — and write the list down with phone numbers. Give it to your pastor and your pregnancy center. If the list is thin, that is the project: fund it, staff it, or drive for it, before arguing about the statute again.
