Federal Court Strikes Oregon Rule Forcing Foster Parents to Affirm Gender Ideology

Rule 11
“If you push a negative hard and deep enough, it will break through into its counterside.”
The alert's own headline — "Federal Court Strikes Oregon Rule" — pushes a real but narrow win past what the record supports. What the Ninth Circuit actually did on July 24, 2025 was reverse the denial of a preliminary injunction and order relief as applied to one applicant, Jessica Bates, on a likelihood-of-success finding, over a dissent; the rule, OAR 413-200-0308(2)(k), was not voided statewide by that opinion, and the permanent order entered in September 2026 runs to Bates. An overclaim like this is the one weapon an opponent can use permanently, because it is true.
Counter-Rule 11 · Proportional Truth
Refuse to overclaim, even where it would help. One exaggeration hands the other side the only weapon that works permanently.
Before repeating this in a Sunday-school class or a foster ministry email, write down the three facts you can defend: a 2-1 panel decision, preliminary relief for one named plaintiff, and a later stipulated permanent judgment in her case plus an agency rule revision. Refuse to say "the rule was struck down for everyone" or "foster parents everywhere are now protected." If someone asks what it means in your state, say "I don't know yet — I've written to the certification office and I'll bring the answer."
Rule 4
“Make the enemy live up to its own book of rules.”
The winning move here was holding the state to its own written book: the panel quoted Oregon's certification rule and its own training materials, including language telling applicants they need not choose between their faith and supporting a child, and then measured the agency's conduct against that text and against the First Amendment. The case turned on documents the state itself wrote and published, not on sentiment about gender ideology.
Counter-Rule 4 · Radical Integrity
Close the gap between stated values and actual practice before anyone else finds it. This tactic only works where the gap is real.
The same test cuts both ways, so close your own gap first: if you tell a certifier you will treat every child placed with you with kindness and meet their medical and safety needs, make sure that is demonstrably true in your home, and answer every certification question honestly rather than strategically. Keep your own paper — the application, the signed standards, the training roster, dated notes of what a worker told you verbally. A file beats a recollection when it matters.
