Court Revives PSU Student's Free-Speech Suit Over Vaccine-Mandate Email

Rule 4
“Make the enemy live up to its own book of rules.”
The panel did not invent a new protection for the student; it held the university to the categories already in the rulebook, finding that PSU's discipline "did not fit any recognized category" under which a school may restrict student speech. The gap the ruling exposes is between a public university's own stated commitment to open inquiry and a conduct process that punished the content of one email sent to an address the university itself set up for objections.
Counter-Rule 4 · Radical Integrity
Close the gap between stated values and actual practice before anyone else finds it. This tactic only works where the gap is real.
Read your own institution's Code of Student Conduct this month and write down the exact section numbers that govern expressive conduct, disruption, and harassment; then ask the conduct office in writing which section applies to an email sent to an official university address. Do the same audit of your own campus group's bylaws and public statements, so that nothing you say about free expression is contradicted by how you treat a dissenter in your own meeting.
Rule 11
“If you push a negative hard and deep enough, it will break through into its counterside.”
The email at issue pushed the objection past its strongest form — a sincerely held religious conviction stated plainly — into "The Mark of the Beast" and vulgarity aimed at named officials. That surplus became the only thing many readers noticed, and it gave the university something to point at other than the religious claim, which is why the case took five years and an appellate reversal to get back to a courtroom.
Counter-Rule 11 · Proportional Truth
Refuse to overclaim, even where it would help. One exaggeration hands the other side the only weapon that works permanently.
Write the exemption request or the objection letter, then cut every line that is contempt rather than conviction, and have one other person read it before you send it. State the belief, the specific requirement it conflicts with, and the accommodation you are asking for — nothing more. Keep the sent copy: a temperate written record is the document that later protects you, and an intemperate one is the document used against you.
