Rule 4
“Make the enemy live up to its own book of rules.”
The whole filing is Rule 4 run in the open: the Upper Midwest Law Center is not arguing values, it is quoting the districts' own written policies and the text of Title IX back at them \u2014 in Moorhead's case the district's own "Prohibition of Harassment and Violence" policy and its discipline provisions for refusing a student's chosen name or pronoun. The leverage comes entirely from a gap between what a district has adopted on paper and what federal law, as the Department of Education now enforces it, requires. The same move works in reverse against anyone whose public claims outrun their own documents.
Counter-Rule 4 · Radical Integrity
Close the gap between stated values and actual practice before anyone else finds it. This tactic only works where the gap is real.
Before you repeat anything at a board meeting, read your own district's policy text and have the policy number and adoption date in hand \u2014 the document, not a news summary of it. If you quote a sentence, quote it exactly and bring the page. And apply the rule to yourself first: if your church or your group has written standards on how it treats families in these disputes, make sure your actual practice matches them, because that gap is the only thing that makes this tactic bite.
Rule 11
“If you push a negative hard and deep enough, it will break through into its counterside.”
The press language pushes the negative hard: districts described as "endangering vulnerable children," a firm branding itself "warriors for justice" against "left-wing special interest agendas." That heat is useful to the side filing, but it is borrowed heat for a reader who then stands up locally and says it about neighbors on his own school board. One overstated sentence \u2014 claiming your district does something its policy does not actually say \u2014 hands the district the only rebuttal that works permanently.
Counter-Rule 11 · Proportional Truth
Refuse to overclaim, even where it would help. One exaggeration hands the other side the only weapon that works permanently.
Claim only what the document supports. If your district's policy allows a name change without parental notice, say that and read the clause; do not upgrade it into a claim about surgery, secrecy, or motive. Where you do not know, say "I don't know yet, I've requested the policy." Write down the distinction between what the 16-district letter alleges and what your district's own text says, and keep the two apart in public.
Rule 3
“Whenever possible, go outside the expertise of the enemy.”
The fight has been deliberately moved off the ground school boards know \u2014 the Tuesday-night meeting \u2014 and onto federal administrative ground: an Office for Civil Rights complaint invoking Title IX, the Constitution, and federal executive orders, plus a parallel letter to the Minnesota State High School League. Few board members can speak to OCR procedure, and Rochester's answer was that it is "reviewing the facts" and cannot comment. Unfamiliar terrain is the point.
Counter-Rule 3 · Preparation and Width
Prepare the unfamiliar ground before you are dragged onto it. "I don't know, I'll find out and come back" beats an improvised answer.
Prepare that ground before you are standing on it. Read the Education Department's own September 28, 2026 announcement on which Title IX regulation is actually in force, so you are not relying on a headline; learn the difference between a request that OCR open an investigation and an actual finding, because they will be conflated. When asked something you have not read, answer "I'll find out and come back" and then do.
