9th Circuit Vacates Ruling Protecting Christian Mission's Faith-Based Hiring
The Ninth Circuit Court of Appeals has vacated a panel ruling that had protected Union Gospel Mission of Yakima's right to hire only employees who share its Christian beliefs, according to ReligiousLiberty.TV. The Mission sued Washington State in March 2023 to preserve its policy of hiring staff who abstain from sexual conduct outside biblical marriage, even for non-ministerial roles like IT and operations. On January 6, 2026, a three-judge panel ruled for the Mission, holding that the church autonomy doctrine protects internal hiring decisions beyond the narrow ministerial exception. On June 18, 2026, the full Ninth Circuit vacated that decision to rehear the case en banc, with oral argument scheduled for September 29, 2026. The State argues the church autonomy doctrine should apply only to formal ministers, not lay staff, and that Washington's anti-discrimination law can be enforced against the Mission's hiring practices for non-clergy positions. Until the en banc court rules, the panel's protective ruling no longer stands.
