Surrogacy Dispute in Dallas Pits Life-and-Death Custody Claims Against Contract
A Dallas courtroom this week became the center of a bitter custody fight over a critically ill newborn born through a commercial surrogacy arrangement, according to Fox News and the Associated Press. California couple Nausheen Gilkar and Omar Ahmed, who call the baby Rumi, are fighting surrogate McKenna West, an Alaska cardiac nurse who calls him Gabriel, over who holds medical decision-making authority. West says the couple asked her to terminate the pregnancy after the baby was diagnosed at 20 weeks with hypoplastic left heart syndrome; she refused and later gave birth in Texas. The couple's attorney disputes that account and says they consented to the baby's Norwood heart surgery on Aug. 17. The child, born Aug. 12, was re-intubated after his condition worsened post-surgery. A court order currently bars West from seeing or holding the baby. Texas Attorney General Ken Paxton had already secured an order requiring hospitals to provide medically necessary care. The judge left custody unresolved and kept the no-contact order in place. Separately, the couple is seeking over $100,000 from West in a breach-of-contract counterclaim tied to their surrogacy agreement.

Scripture teaches that life in the womb is God's handiwork, not a negotiable term subject to termination clauses. Whatever the disputed facts about who agreed to what, the underlying structure — a paid arrangement in which one party allegedly sought to end the child's life over a diagnosis, and money changing hands over 'breach' of that expectation — reveals the commodification risk inherent in commercial surrogacy. Christians should recognize that surrogacy contracts can place fallen human arrangements above the sanctity of the child and the God-given authority of parents, and that civil courts are now being asked to referee decisions that a biblical view of family and life was meant to settle before conception.
