Santa Fe Public Schools revised its gender policy on August 20, now requiring parents or guardians to approve any "Gender Support Plan" before it takes effect, according to Washington Examiner reporter Amy DeLaura. Previously, students alone decided whether parents were told about a transition. The plans still let students use restrooms matching their stated gender identity and require staff and classmates to use preferred names and pronouns — and the district still does not notify other families when their children will share private facilities with a student of the opposite biological sex. Liberty Counsel, representing New Mexico parents, filed a federal civil rights complaint with the Department of Education's Office for Civil Rights in March after the district rejected an earlier demand letter. Founder Mat Staver said the district still risks losing federal funding and DOJ litigation over alleged Title IX violations. The change followed a complaint from Santa Fe mother Kristy Borrero Ojinaga, who said her six-year-old daughter was followed into the girls' restroom and subjected to inappropriate conduct by a male classmate with a Gender Support Plan; a district wellness coordinator reportedly called the behavior "typical and normal."
