Pro-Life Group Urges DOJ to Enforce 1873 Law Against Mail-Order Abortion Pills

Pro-Life Group Urges DOJ to Enforce 1873 Law Against Mail-Order Abortion Pills
Status: MediumSeverity: 1 - Worth Knowing

The Restoration of America Foundation (ROAF) has released a report urging the Trump administration to enforce the 1873 Comstock Act against mail-order abortion drugs, Fox News Digital reports. ROAF CEO Doug Truax argues the law makes it illegal to mail abortion-inducing drugs and is calling on Attorney General Todd Blanche to withdraw a December 2022 Biden-era Office of Legal Counsel opinion that concluded the Comstock Act does not bar mailing mifepristone or misoprostol absent intent for unlawful use. ROAF's report says nearly 15,000 medication abortions a month were provided under blue-state shield laws by June 2025, and that mail-order drugs were 'directly responsible' for more than 300,000 abortions in 2025. The group cites an insurance-claims analysis finding serious adverse events in 10.9%-11.2% of drug-induced abortions from 2017-2023, far above the rate on the FDA label. Blanche has said he is reviewing DOJ's interpretation of the Comstock Act. The report's release is timed ahead of Planned Parenthood's Oct. 16 anniversary.

Why Bible-Believing Christians Should Care

Scripture affirms that human life in the womb is known and formed by God, making abortion a matter of life and death, not merely policy (Jeremiah 1:5; Psalm 139:13-16). Christians should watch this closely because the expansion of mail-order abortion pills under shield laws has moved abortion past state-level restrictions entirely, reaching women in pro-life states through the mail. Whether or not the Comstock Act is ultimately enforced, believers should understand the legal and administrative mechanisms shaping whether unborn life receives any protection in federal law, and should hold elected and appointed officials accountable to pursue justice for the vulnerable.

Before I formed thee in the belly I knew thee; and before thou camest forth out of the womb I sanctified thee — Jeremiah 1:5

In the judicial sphere, personalization gets applied to enforcement itself. Progressive prosecutors are elected with support from activist networks, then use discretion to enforce selectively. Crimes that advance the narrative are prosecuted aggressively. Crimes that contradict it are ignored. The law stops being a neutral shield and becomes a partisan weapon.
