NJ Law Creates Crime for 'Interfering' With Abortion Access; Critics Cite Vague Terms
Governor Mikie Sherrill has signed New Jersey legislation creating the crime of "interference with reproductive health care services," establishing criminal and civil penalties for conduct that knowingly or purposely intimidates, obstructs, or otherwise interferes with people seeking or providing abortion and related services. Offenses range from a fourth-degree crime (up to 18 months in prison, $10,000 fine) to second-degree crimes carrying five to ten years if serious bodily injury results. The law also allows civil lawsuits by alleged victims and enforcement by the state Attorney General, with penalties up to $25,000 for repeat violations. Beyond the new offense, the law limits New Jersey cooperation with out-of-state investigations into abortion-related activity legal in the state, restricts extradition in some cases, and strengthens patient confidentiality protections. New Jersey Right to Life and other pro-life groups have publicly criticized terms like "intimidate" and "interfere" as overly broad, warning they could be applied to peaceful sidewalk counseling, demonstrations, or prayer outside clinics. The bill's committee statement does not mention prayer specifically, and does not state that peaceful prayer is automatically prohibited.

History shows vague speech-adjacent laws are rarely applied narrowly once passed.
