Rule 3

“Whenever possible, go outside the expertise of the enemy.”

The fight was moved onto ground where the parent had no standing expertise: a verbal agreement with a fourth-grade teacher counted for nothing, and the district answered a religious accommodation request by granting only "the narrow opt-out already required by state law" — a statutory line (Washington's comprehensive sexual health education excusal, RCW 28A.300.475) that most parents have never read. The father could only press the point by retaining Alliance Defending Freedom and filing in federal court; the district, meanwhile, needed only to say it follows applicable law and OSPI guidance.

Counter-Rule 3 · Preparation and Width

Prepare the unfamiliar ground before you are dragged onto it. "I don't know, I'll find out and come back" beats an improvised answer.

Read the two documents that decide this before you need them: your state's sexual-health-education statute (in Washington, RCW 28A.300.475, which says a written excusal request "must" be granted) and your own board's policy and procedure numbers on instructional materials and parental requests. Then put every request in writing, dated, to the person the policy names as the designee, and keep the reply. When an administrator cites a rule you do not know, say you will look it up and come back rather than conceding on the spot.

Rule 4

“Make the enemy live up to its own book of rules.”

The district's public position is that it follows "all applicable federal and state laws and guidance from the Office of the Superintendent of Public Instruction" — and the suit is precisely a test of whether the classroom practice matched that book of rules, given a June Pride Month lesson delivered with no advance notice after a teacher had agreed to notice and an opt-out. Since June 27, 2025, Mahmoud v. Taylor is part of the applicable law the district says it follows.

Counter-Rule 4 · Radical Integrity

Close the gap between stated values and actual practice before anyone else finds it. This tactic only works where the gap is real.

Use the tactic in the honest direction, and first on yourself: follow your district's own written procedure exactly — right form, right designee, right dates — so there is no gap on your side. Then ask the district in writing to identify how its notice practice satisfies the one-month advance-notice requirement OSPI publishes, and request the minutes or policy revision, if any, adopted after Mahmoud. Compare document to practice and record dates rather than characterizing motives.

Rule 7

“A tactic that drags on too long becomes a drag.”

Time is the district's ally here. The sequence runs from a September 2025 teacher conversation, to a June Pride Month lesson given without notice, to a renewed request at the start of fifth grade, to a federal lawsuit whose outcome is unknown and whose docket will outlast the school year in question — the boy will have moved on before any ruling lands. Parents who lack a legal organization simply run out of school year.

Counter-Rule 7 · Strategic Steadfastness

Outlast it. Novelty is the attacker's fuel and it runs out faster than patience does.

Plan past this term: keep a one-page dated log of every request, reply, and lesson given without notice, and re-file the written request each August rather than relying on last year's agreement. Ask two or three other parents to file their own written requests the same week so the record does not depend on one family's stamina. Put a standing reminder to check board agendas monthly for policy revisions.
