Carson City School Attorney Can't Cite Law Behind Gender-Reporting Policy

Rule 3
“Whenever possible, go outside the expertise of the enemy.”
Counsel is the only lawyer in the room, and "it's the law" moves the decision onto ground the trustees cannot independently check — exactly the move of arguing where the other side lacks expertise. When Trustee Pedersen asked for definitions and legal citations, she was offered "less nefarious language" instead of a statute, which substitutes wording negotiation for the legal question actually asked. The reported fact that the same counsel omitted these provisions from the Douglas County overhaul the same month is the sentence that shows the legal ground was never firm.
Counter-Rule 3 · Preparation and Width
Prepare the unfamiliar ground before you are dragged onto it. "I don't know, I'll find out and come back" beats an improvised answer.
Prepare the unfamiliar ground before the next meeting: put the two districts' drafts side by side, read Washoe's Regulation 5161 in full text rather than in summary, and get the district's own policy-revision procedure. Then ask in writing for the citation — chapter, section, or case name — and accept "I will find out and come back" from yourself as well as from counsel. A trustee or member who can name the document beats one who can only name a conviction.

“Power is not only what you have, but what the enemy thinks you have.”
The force behind this policy is an assertion of legal compulsion that no one has yet seen on paper — power as what the other side believes you have. Carson Now reports no citations have been given to trustees or the public, Douglas County's parallel update contains none of these provisions, and Washoe's Regulation 5161 runs the opposite direction; three counts that a binding statewide mandate has not been produced. The claim is doing the work the citation would do.
Counter-Rule 1 · Reality Over Perception
Count the actual numbers. The phantom army depends on nobody checking whether it exists.
Count what actually exists. Request the written legal opinion, the redline as presented on August 11, 2026, and the Douglas County draft, and read whether any of them names a law. If a real mandate exists it can be stated in one line — so a refusal or delay is itself the finding, and one calm public reading of "here is what the record contains" is worth more than an argument about motives.
Rule 11
“If you push a negative hard and deep enough, it will break through into its counterside.”
The material here invites pushing a negative until it flips: "the attorney could not cite the law" slides easily into "the attorney is concealing an agenda," and the word "nefarious" is already in the story. It would be equally easy to overclaim the other way and say nondisclosure policies are settled illegal, which is the very claim currently lacking a citation. Either exaggeration costs the reader the one asset that matters at a podium — being right about the record.
Counter-Rule 11 · Proportional Truth
Refuse to overclaim, even where it would help. One exaggeration hands the other side the only weapon that works permanently.
Say only what the documents support: as of the second reading, no citations had been produced; Douglas County's update omitted the provisions; Washoe's regulation restricts disclosure. Do not say counsel lied, and do not assert that either notification or nondisclosure is legally required until you can hold up the text. Write your public comment out beforehand and strike any sentence you cannot source to a page or a meeting date.
