The Ninth Circuit Court of Appeals issued an order this week pausing a district court injunction that had limited enforcement of Idaho's near-total abortion ban, the Lewiston Tribune reports. The case stems from a lawsuit by the Lawyering Project and Legal Voice on behalf of Dr. Stacy Seyb, a St. Luke's Health System maternal-fetal medicine specialist, challenging Idaho's Defense of Life Act for lacking a health exception. On Aug. 13, U.S. District Judge B. Lynn Winmill ruled the law unconstitutional on those grounds, barring the Ada County prosecutor and Idaho Attorney General Raúl Labrador from enforcing it when a doctor determines a pregnancy poses a 'non-negligible risk' to the mother's health. Labrador sought an emergency stay, arguing the injunction violated the Dobbs ruling and was too broad. Winmill narrowed the injunction to Seyb's practice specifically. The Ninth Circuit's Thursday order now pauses even that narrowed injunction pending full briefing, with oral arguments scheduled for Sept. 22 on whether the pause should continue.
