Can my employer make me sign a diversity statement?

In most cases you can ask for the statement in writing, sign the parts that are simply true, and decline to affirm anything that asserts a belief you do not hold. Federal law generally protects employees from religious discrimination and generally requires employers to consider a religious accommodation when a sincerely held belief conflicts with a workplace requirement. Ask for the accommodation in writing, in calm language, and keep working with excellence while it is under review.

What is actually happening

A signature is being requested where an acknowledgment would do. An acknowledgment says you read the policy and will follow it. An affirmation says you believe a contested set of claims about people, history, and morality, and it is that second thing the form is usually fishing for. The list of who signed and who did not becomes a record, and the ones who did not sign stand alone in it.

What the law generally says

In the United States, federal law generally prohibits employers from discriminating against workers because of religion, and generally requires an employer to consider a reasonable accommodation for a sincerely held religious belief unless doing so would impose a real burden on the business. Employers may generally set conduct policies and require employees to acknowledge them, and there is usually a difference in the law between acknowledging a policy and affirming a belief. Public employers are generally more limited than private ones, because government bodies face constitutional restrictions on compelling speech. Most states follow at-will employment, though a number of states add their own protections for religious expression or off-duty belief.   1. Ask for the statement, the policy behind it, and the deadline in writing. Email is enough: "Could you send me the document and the policy it comes from so I can review it carefully?"
  2. Read it line by line and mark two columns: what is conduct you can honestly promise, and what is belief you would be affirming. Most of these documents are mostly the first kind.
  3. Put your accommodation request in writing before the deadline, in one short paragraph, naming the specific lines you cannot affirm and offering what you can sign instead.
  4. Quietly find the others. Someone else in your building has the same problem and thinks he is the only one. Talk before anyone answers, not after.
  5. Keep a dated file of every message, meeting, and verbal instruction about the statement, written the same day it happens.
  • Document contemporaneously. Notes written the week it happened carry weight; notes written after a termination carry very little.
  • Ask for the acknowledgment-only alternative by name. It is a small, specific request that is hard to refuse in writing and easy to refuse in a hallway.
  • Do not go quiet and do not go loud. Missing the deadline without a written request looks like insubordination, and a speech to the department hands them the reaction the form was hoping for.
