Massachusetts Governor Signs Bill Expanding Abortion Access Throughout Pregnancy

Rule 3
“Whenever possible, go outside the expertise of the enemy.”
The change moves the argument off ground a citizen can read and onto ground only clinicians can occupy: H.5595 strikes the four written conditions in section 12N of chapter 112 that governed abortions at or after 24 weeks and substitutes "the professional judgment of the physician." Procedurally the same move was made — the bill was reported out of House Ways and Means as a substitute for H.2370 on July 21, passed the House July 22, and cleared the Senate on July 31, the last day of formal session, on a 15-4 standing vote with no record of who voted. Both the legal standard and the calendar were placed where an ordinary objector has no footing.
Counter-Rule 3 · Preparation and Width
Prepare the unfamiliar ground before you are dragged onto it. "I don't know, I'll find out and come back" beats an improvised answer.
Read the two operative sections yourself this month — the enacted text is short, and the old and new wording of section 12N sit side by side on the Legislature's bill page. Learn one piece of procedure: how a Ways and Means substitute bill bypasses a committee hearing, and what a standing vote is versus a roll call, so you can say precisely what happened rather than that it was "rushed." When asked a clinical question you cannot answer, say you will find out and come back with a source.
Rule 11
“If you push a negative hard and deep enough, it will break through into its counterside.”
The case for repeal was carried by the hardest facts available — catastrophic late-pregnancy diagnoses and families who had to leave the state — pushed hard enough that a 24-week limit reads as cruelty rather than protection. The same mechanism runs the other way in this alert: a Breitbart headline about abortion "throughout the full term" reached the reader before the bill number, the vote counts, or the text did, and Snopes has already published a check on that framing.
Counter-Rule 11 · Proportional Truth
Refuse to overclaim, even where it would help. One exaggeration hands the other side the only weapon that works permanently.
Say only what the record supports: the law removes the statutory conditions on abortion at or after 24 weeks and substitutes a physician's professional judgment, and it does not put the decision in the patient's hands alone. Carry the CDC figure that abortions after 21 weeks were about 1.1% of the total in 2022 rather than avoiding it. Refuse to repeat "abortion until birth" in a public meeting unless you can quote the enacted sentence that produces it — one overstatement will cost you the whole hearing.
Rule 12
“The price of a successful attack is a constructive alternative.”
Supporters did not merely attack the old four-prong framework; they arrived with something to put in its place — a named woman speaking at the signing, and the claim that patients facing devastating diagnoses will now be cared for in-state. That constructive offer, not the legal argument, is what carried the bill in a week.
Counter-Rule 12 · Universal Construction
The book agrees with this one rather than inverting it: if you would tear something down, you are obliged to build the thing that replaces it.
Answer it with something equally concrete rather than with a statement: find out this month whether any hospital or hospice near you offers perinatal hospice for a lethal-diagnosis pregnancy, and write down the name, phone number and cost. If your parish or center cannot name one, that gap is the work. Ask your pregnancy center what it can actually provide to a family at 26 weeks with a fatal diagnosis, and put the answer in writing before you criticize the law in public.
