Rule 7

“A tactic that drags on too long becomes a drag.”

The operative move in this story is delay, not argument. HHS announced the mifepristone review in the fall of 2025; the FDA's own Q&A page was still saying in April 2026 that it was collecting the data needed for a well-powered study; the study reportedly launched in June 2026 with a six-month horizon; the Louisiana case was paused in April and now the Texas-Florida case is stayed to December 1, 2026. Nobody has to win an argument if the calendar can be made to outlast the people watching.

Counter-Rule 7 · Strategic Steadfastness

Outlast it. Novelty is the attacker's fuel and it runs out faster than patience does.

Outlast it with a calendar, not with indignation. Write down four dates this month — September 2025 (review announced), June 2026 (study launched), October 7, 2026 (FDA's court-ordered status report in the Louisiana case), December 1, 2026 (end of the Texas-Florida stay) — and set reminders for the last two. Check the FDA's mifepristone Q&A page monthly and note whether the 'as of [month]' wording changes; a page that says the same thing in November as it did in April is itself a finding worth recording.

Rule 4

“Make the enemy live up to its own book of rules.”

The strongest ground here is the government's own book. The FDA has published, on its own website, that it is conducting a safety study; a federal court in Louisiana has ordered it to report on that study's progress by October 7, 2026; and Judge O'Connor granted the stay on the strength of that same commitment. Every question a citizen needs to ask can be asked in the agency's own words and the court's own deadline.

Counter-Rule 4 · Radical Integrity

Close the gap between stated values and actual practice before anyone else finds it. This tactic only works where the gap is real.

Close your own gap first. When you write or speak, cite the FDA's published figure — 36 death reports associated with mifepristone through December 31, 2024, on the agency's Q&A page — with its date, rather than rounder or older numbers you cannot source. Ask any organization you fund for the docket number and date of the filings it says it made, and keep the reply; a claim you can hand someone in writing survives a hostile room, and one you cannot does not.

Rule 11

“If you push a negative hard and deep enough, it will break through into its counterside.”

Two claims in circulation around this story are being pushed harder than the record carries them: that the review was deliberately timed to fall after the November midterms (the alert itself says 'reportedly'), and an approximately 11% complication rate drawn from an advocacy think tank's insurance-claims analysis, not from an FDA finding. Either one, stated flatly as fact in a public setting, hands an opponent the correction that discredits everything said with it.

Counter-Rule 11 · Proportional Truth

Refuse to overclaim, even where it would help. One exaggeration hands the other side the only weapon that works permanently.

Say the sourced thing and stop. In a meeting or a letter, state the dates and the FDA's own published language; if you raise the post-midterm timing, say it has been reported and by whom, not that it is established. If you use the 11% figure, name the Ethics and Public Policy Center as its source and note it is a claims-data study, not an agency conclusion — or leave it out and use the FDA's own numbers, which are harder to dismiss.
