Federal Judge Again Blocks Texas AG From Enforcing Anti-Drag Show Law
U.S. District Judge David Hittner issued an amended injunction on August 25 barring Texas Attorney General Ken Paxton from enforcing Section One of Senate Bill 12, the state's 2023 law restricting sexually oriented performances before minors, according to the Dallas Express. Paxton has vowed to appeal immediately, though no notice of appeal or stay request had been filed as of Friday morning, meaning the injunction currently stands. The Fifth Circuit had earlier vacated Hittner's original 2023 injunction and sent the case back for further review under specific constitutional tests, but did not declare SB 12 constitutional. Hittner found the law's language — including undefined terms like 'lewd' and 'prurient interest in sex' — unconstitutionally vague and capable of reaching protected expression such as theater or comedy, not just the sexualized conduct lawmakers cited, including a 2022 all-ages incident at a Plano venue. The ruling applies only to Paxton's civil enforcement of Section One; local prosecutors in some counties were not bound by the appellate vacatur, leaving other enforcement avenues, including Section Two and Section Three penalties, unresolved.
