The alert's own text concedes that the outlet "has not yet detailed which agency is issuing the guidance, its scope, or a release date" — there is no document to read, only a report that one is coming. The alarm a foster or adoptive family feels here is being generated entirely by an unnamed, unpublished thing; the statute and regulations that actually govern their case have not changed at all.
Counter-Rule 9 · Courageous Realism
Name the worst case out loud and cost it honestly. Fear of the unnamed is doing most of the work.
Cost the worst case out loud this month: read 25 U.S.C. §1915, which sets the placement preferences and already applies today, and note that they operate "in the absence of good cause to the contrary." Then ask your caseworker in writing whether ICWA applies to your specific child and get the date of the determination. Once you know your own case's posture, an unpublished guidance document loses most of its power to frighten you.
