Rule 4

“Make the enemy live up to its own book of rules.”

The case did not turn on the merits of the surgery but on Kaiser's own paperwork: the Third District Court of Appeal held on September 19, 2025 (Brockman v. Kaiser Foundation Hospitals, C101451) that Kaiser had not proved by a preponderance of the evidence that the arbitration agreement it was invoking actually existed as to this patient, because the referenced documents were never supplied. The institution was held to the rules it wrote for itself — enrollment forms, benefit booklets, consent — and the gap between its documents and its claims cost it the forum it wanted.

Counter-Rule 4 · Radical Integrity

Close the gap between stated values and actual practice before anyone else finds it. This tactic only works where the gap is real.

Do the same thing to your own paperwork before someone else does. This month, pull your family's own health-plan enrollment packet and read the arbitration clause and the minor-consent forms; if your church runs a youth or counseling ministry, check that its written intake and parental-consent practice matches what the leadership says from the platform. Where a stated value and an actual document disagree, fix the document, in writing, and date it.

Rule 13

“Pick the target, freeze it, personalize it, and polarize it.”

The whole campaign is built on one named person: a federal bill is titled the Chloe Cole Act, and a single Manteca woman's medical history has become the frozen, personalized image for a nationwide policy fight — with the predictable result that opponents now litigate her personally, disputing her account rather than the bill's text. Kayla Lovdahl's parallel San Joaquin County suit gets a fraction of the attention because the target has already been picked and frozen.

Counter-Rule 13 · Radical Solidarity

Stand publicly with whoever has been singled out. Isolation is the whole mechanism; refusing it disarms the tactic.

Refuse the isolation in both directions. Read H.R. 7651's actual text on congress.gov and argue the bill's provisions rather than one woman's biography, so the argument does not collapse if she is discredited; and if a teenager or family in your own congregation is on the other side of this question, make sure someone sits with them by name this month rather than leaving them to be a category.

Rule 12

“The price of a successful attack is a constructive alternative.”

The bill's whole architecture is prohibition plus a private right of action — it bars the interventions and lets families sue, but the distressed 13- and 15-year-olds in the two San Joaquin County complaints still existed and still needed something. A successful attack on a treatment pathway obliges its critics to name what a frightened parent should do instead at 10 p.m. on a Tuesday.

Counter-Rule 12 · Universal Construction

The book agrees with this one rather than inverting it: if you would tear something down, you are obliged to build the thing that replaces it.

Before your church circulates either lawsuit as a cautionary tale, ask the family ministry to write down, on one page, the specific alternative: named local counselors who take teenagers, who pays, how a parent gets an appointment within two weeks, and who in the congregation walks with the family. Ask for that page to be approved and dated. Decline to hand out the story without the page.
